European Court of Justice supports federal regulation of online gambling

In a ruling published Thursday, the European Court of Justice supported Germany’s strict federal regulation of online gambling, saying it was justified even though the regional state of Schleswig-Holstein had temporarily eased the rules.

In a case brought by Digibet challenging the legitimacy of a German block on its offering to German punters, the Court noted:

“The 15 remaining [German] states are not required to change their rules just because a single state had pursued a more liberal policy for a limited time.”

Digibet.com had earlier claimed that the more liberal rules applied by the regional state of Schleswig Holstein implied that these rules should also apply in the rest of Germany.
