DraftKings sued by CG Technology in patents filing

News on 9 Apr 2016

Daily fantasy sports operator DraftKings is facing a new challenge this week after news broke that CG Technology (formerly Cantor Gaming and Wagering) has filed litigation alleging 8 instances of infringements of its US patents and seeking increased damages and attorneys’ fees.

Few details of the content of the filing are yet available, but the case is recorded in the Nevada District Court as filed on April 7 under case number 2.2016cv00781 with the plaintiff listed as CG Technology Development, LLC, Interactive Games LLC and Interactive Games Limited, which have asked for a jury trial.

Federal Judge the Hon Richard F. Boulware is scheduled to preside over a court date yet to be set.

Early reports indicate that CG Tech fired off a “wilful infringement” patent warning to DraftKings on July 15 last year, suggesting an amicable settlement to resolve the issue.

The patents which CG Tech alleged were infringed were listed as 39818, 6899628, 8641511, 8342924, 7029394, 6884166 and 7534169.

Apparently this attempt to avoid the costs and time of a judicial action failed, leading to the litigation being filed this week.
