Dutch advertising regulations in force

News on 1 Jul 2013

As of today (Monday) all gambling providers operating in the Dutch market are required to adhere to the Decree that regulates advertising of gambling products.

Operators are immediately required by law to indicate the risks of gambling on all advertising activities just as alcohol and tobacco manufacturers are required to do, Justice Minister Fred Teeven said Monday.

As of October 1, 2013, all operators offering games of chance will be required to indicate minimum age requirements and publish a link referring players to additional information on identifying and dealing with problem gambling on their website and on all promotional activities.

Additionally operators will be required to provide the Kansspelautoriteit with an annual report on their customer acquisition and advertising activities which must include the number of advertising complaints and the number of times a subscribed player is sent promotional material.

Teeven is tasking gambling providers and other stakeholders to come up with an effective slogan that warns of the dangers of gambling using the alcohol industry’s “Drink destroys more than you care to think” as an example.
